1) Acceptance of terms

By accessing or using the Menu Designer AI platform, APIs, documentation, or any related services ("Services"), you agree to these Terms. If you are using the Services on behalf of a company, you represent that you have authority to bind that company.

2) Account and permissions

You are responsible for safeguarding credentials and API keys. You must ensure only authorised users access the Services and that permissions you assign are appropriate for your organisation.

3) Acceptable use

• No unlawful, harmful, or abusive use of the Services.
• No reverse engineering, interference, or disruption of the Services or underlying infrastructure.
• No use that exceeds rate limits or degrades service for others.
• No upload of malicious code or violation of third-party rights.

4) Data and privacy

You retain ownership of your submitted data. You grant us a non-exclusive licence to process that data to provide and improve the Services. You must ensure you have all necessary rights and notices for the data you submit.

5) Intellectual property

The Services, software, models, designs, and documentation remain our exclusive property. No rights are granted except the limited right to access and use the Services under these Terms. Do not remove or obscure proprietary notices.

6) Availability and changes

The Services are provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue features with reasonable notice where practical. You are responsible for keeping integrations compatible with published APIs and versions.

7) Disclaimers

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. You are responsible for validating outputs before production use.

8) Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, revenues, data, or business interruptions. Our aggregate liability for any claim is limited to the amount you paid for the Services in the 3 months preceding the claim.

9) Indemnity

You agree to indemnify and hold us harmless from claims arising from your use of the Services, your content, or your breach of these Terms.

10) Suspension and termination

We may suspend or terminate access for violations of these Terms, security risks, or non-payment. On termination, your access to the Services and API keys may be disabled. Provisions relating to ownership, disclaimers, limitations of liability, and indemnity survive termination.

11) Governing law

These Terms are governed by the laws of England and Wales. Courts of England and Wales shall have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction.

12) Changes to these terms

We may update these Terms from time to time. Material changes will be communicated via the product or email where possible. Continued use after changes becomes effective constitutes acceptance.
